A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
The defendant, as the representative director of F, is between the victim G and the South, and on June 26, 2009, he succeeded to H land in Chuncheon-si (divided on December 2, 201, and changed to H, I, and J) and shared 1/2 shares with the victim.
1. Forging a real estate sales contract;
A. The Defendant forged a private document did not have been delegated by the Victim G with regard to the sale of shares in the victim’s land.
Nevertheless, the Defendant: (a) around February 1, 2012, via a computer from LA4 site column to the LA4 site column by using the computer delegated by the Defendant at the LA certified judicial scrivener office located in Chuncheon-si, and (b) around February 1, 2012, the Defendant: (c) stated the sale price and the payment period column in the LA4 site column in the LA4 site column; (d) stated the sale price and the amount of 9,918 square meters (30 square meters): (e) KRW 9,835 square meters; (e) KRW 9,918 square meters (30 square meters): (e) KRW 19,835 square meters; (e) KRW 30 million in the contract; (e) KRW 720 million in the remainder; (e) by January 31, 2012; and (e) the seller column stated the name and seal of 508 Seocho-gu Seoul, Yeongdeungpo-gu N-125; (e) resident number:O, P, Q, Q, name name, and 30 in Seoul building column.
Accordingly, the defendant, for the purpose of exercising rights and duties, forged one copy of a real estate sales contract in the name of the victim.
B. The Defendant: (a) had a certified judicial scrivener who may know of the foregoing circumstances use a forged real estate sales contract in the registration of transfer of ownership as a result of the use of the forged real estate sales contract; and (b) exercised the forged real estate sales contract as if it was duly formed.
C. Unauthorized entry in a notarial deed and the Defendant’s exercise of that deed were forged on February 1, 2012 through LAD’s office Secretary V in the registration division of the Chuncheon District Court located in Chuncheon on February 1, 2012.
