A defendant shall be punished by imprisonment for not more than ten months.
Seized evidence 1 to 8 shall be confiscated.
Reasons
Punishment of the crime
The Defendant, as a foreigner of the nationality of Malaysia, was liable for 10,00 U.S. dollars to 20 persons, such as Malaysia’s name “C”, but failed to repay the debt. As such, the Defendant was demanded from the above “C” to purchase a high-priced visibility at a foreign duty-free shop, such as Korea, using a credit card forged in the name of the Defendant, and then bring the Malaysia into Korea.
1. On May 2, 2014, around 12:48, the Defendant purchased at the victim’s new duty-free shop located in the third floor of the Incheon International Airport passenger terminal in Jung-gu Incheon International Airport passenger terminal, 272, and, at the victim’s employees, suggested that he/she was normally issued a credit card under the Defendant’s name as a credit card, one of the forged Ameras Credit Card (Serial number: D) and had the said employees settle the account, thereby allowing the said employees to deliver one of the above 10,773 U.S. dollars owned by the victim.
On May 4, 2014, around 08:06, the Defendant purchased one clock at the above new duty-free shop, and suggested that the Defendant would normally be issued to the employees of the victim a letter of credit card of the Si bank (number E) that is forged in the name of the Defendant, and had the said employees settle the account, thereby having the Defendant issued one clock at the above 6,990 U.S. dollars owned by the victim.
In this respect, the Defendant, using forged credit cards on two occasions, acquired two clocks of USD 17,763 (1,8150,000) in total from the victim.
2. Violation of the Specialized Credit Finance Business Act;
(a) No person who uses forged or altered credit cards shall use such forged or altered credit cards;
Nevertheless, the Defendant used the forged credit card under the name of the Defendant twice as described in paragraph (1).
(b) No one shall acquire forged or altered credit cards for the purpose of uttering;
