Reasons
Punishment of the crime
" 2020 High 69"
1. From October 12, 2020 to around 02:00 on October 12, 2020, the Defendant: (a) acquired the e-mail card lost by the victim D at the seat of the C Bank No. C Bank from around 03:00; and (b) did not take necessary procedures such as returning it to the victim; and (c) embezzled the e-mail card as he/she thought he/she had.
2. Violation of the Act on Financial Business Specializing in Credit, and fraud, the Defendant, at around 11:16 on the same day, obtained D’s e-mail card from G F and 2, as above 1:00 won in an unmanned settlement machine, and settled 20,000 won in use by inserting the e-mail card from G F and 2, and at around 1:38 on the same day, the Defendant purchased the e-mail tobacco 2 A at H at around 11:38, by settling 9,000 won with the above e-mail card, acquired a total of KRW 29,000, and used the lost debit card unlawfully.

1. The crime on September 16, 2020;
A. On September 16, 2020, around 13:30 on September 16, 2020, the Defendant: (a) acquired a copy of the K Cze Card owned by the VictimJ in front of the bus stops located in front of the new bus stops located in 25-gil-si, the Defendant embezzled that he would own without following necessary procedures, such as returning it to the victim; and (b) embezzled it as it is, without undergoing necessary procedures.
B. On September 16, 2020, the Defendant attempted to settle KRW 20,00 through an unmanned settlement machine installed on the said PC without authority, by using the e-mail card acquired as stated in the above paragraph from the 2nd MPC room located in L on September 16, 202, as if he were his card, at around 14:00 on September 16, 202. However, the Defendant failed to settle due to the shortage of the balance and failed to do so.
2. A crime on September 20, 2020;
A. On September 20, 2020, the Defendant, from around 15:36 to around 17:00 to around 17:00, and from around “O” located in Gongju-si, obtained the Victim P’s Q&C card, and without going through necessary procedures, such as returning it to the victim.
