1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Facts of recognition;
A. On October 20, 1983, BD 1,361 square meters was divided into one-third share and one-third share transfer registration was completed in each of the Defendants’ future on June 1, 1989; BE large 174.6 square meters; BF large 226.1 square meters; BG large 230.4 square meters; BG large 196.7 square meters; BH large 193.8 square meters; BH large 193.8 square meters; BI large 151.5 square meters; BJ large 187.9 square meters, respectively.
(hereinafter referred to as "land by lot number").
On June 1, 1989, the land category was changed to a road upon the application of the Defendants.
(hereinafter referred to as the “instant land”) with respect to the above BJ roads.
After that, the above BD site was newly constructed in the west Construction Co., Ltd. (hereinafter “west Construction”), in the future of the above BE site, in the future of the west Construction; BF site in the future of the west Construction; BG site in X; BH site in the future of the BG site; BH site in the future of the BM on June 19, 1989; and BI site in the future of the BM, the ownership transfer registration was completed on June 21, 1989; the above 6 lots of land in each of the above 6 lots of land after obtaining a building permit from the owner of each of the above 6 lots of land in each of the above 6 lots of land; and the above 6 lots of land in each of the above 6 lots of land except the land in this case was completed the registration of each ownership right on the 6 lots of land in December 1989.
C. At present, three sides of the instant land are connected to BO road, where one side is a meritorious road. On the other hand, since three sides of the instant Bara are surrounded by walls, the residents of the instant Bara and the general citizens who intend to enter the said Bara are using the instant land as the access road and the passage of the instant Bara.
The plaintiffs are currently divided owners of the loan of this case.
