1. Basic facts

A. On November 6, 2013, the Plaintiff entered into a subcontract (hereinafter referred to as “instant subcontract”) with the Defendant, who was awarded a contract for a new construction project on the scale B of the 15th underground floor and the 15th above ground (the 1-4th floor officetels, 5-15th apartment floor above the ground) located in Busan-gu, Busan-do and the 116,107,50 won for the construction cost (including value-added tax) among the new construction projects, and the construction cost of the 116,107,50 won for the damp-gu construction project (hereinafter referred to as “instant construction project”) and from November 6, 2013 to February 28, 2014, the Plaintiff changed the subcontract to the 137,84,750 won for the construction cost after concluding the subcontract (including value-added tax).

B. The Plaintiff completed the construction work around September 2014.

2. The parties' assertion

A. The Plaintiff received only KRW 84,476,064 out of the principal construction cost of this case 137,84,750, and the Defendant is obligated to pay the Plaintiff the amount of the principal construction cost of KRW 53,368,686 and the amount of the additional construction cost of KRW 73,00,000,000,000,000,000 for the main construction cost of this case.

B. Of the Defendant’s principal construction cost of KRW 112,848,064, out of KRW 137,844,750 = KRW 90,848,064 paid by the trustor of the ordering authority to the Plaintiff’s 15 million paid to the Plaintiff’s Plaintiff’s husband.
