1. The Defendant’s KRW 124,292,457 as well as 5% per annum from December 18, 2019 to October 13, 2020 to the Plaintiff.
Reasons
1. Name of a contract for construction works: The location of the site for the construction of the Yangcheon-gu Seoul Metropolitan Government 4th ground: Five months from the date of commencement (excluding the delayed days due to a natural disaster and the number of days of discontinuance of construction due to a civil petition): 508,000,000 (the cost of construction works: 455,000,000, additional construction costs: 53,000,000) principal construction cost payment and the down payment period and 10% of the cost of construction works: 45,50,000,000 basic construction cost and 20% at the time of commencement of the framework construction work, 91,000,000,000, 30% at the time of completion of the aggregate construction works, 136,500, 1300, 50% at the time of completion of additional construction works, 30% at the time of completion of construction works at the time of completion of construction work, 100,0005% at the additional construction cost;
A. On May 21, 2017, the Defendant concluded a contract for construction work (hereinafter “instant contract for construction work”) with the Plaintiff, the owner of the building, and the new construction work for the five-story housing located in Yangcheon-gu Seoul Metropolitan Government (hereinafter “instant housing”), with the total construction cost of KRW 508,00,000 (including the additional construction cost of KRW 455,00,000,000, and the elevator construction cost of KRW 53,000,000, and the elevator construction cost of KRW 53,000). The main contents are as follows.
B. On May 25, 2017, the Plaintiff paid the Defendant KRW 308,50,000 in total,00,000,000 on June 7, 2017, and KRW 50,000,000 on June 20, 2017, and KRW 41,000,000 on June 29, 2017, and KRW 126,50,000,00 on August 8, 2017.
In addition, on behalf of the Defendant, the Plaintiff paid D Co., Ltd. totaling KRW 38,500,000 on August 4, 2017, including KRW 7,700,000, KRW 15,000 on April 12, 2018, and KRW 15,800,000 on May 25, 2018.
C. Meanwhile, on November 16, 2017, the Defendant suspended the instant construction project while performing the instant construction project, and went away from the site.
