A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence shall be confiscated from the accused.

Punishment of the crime

No one shall use a trademark identical with or similar to another person's registered trademark on goods identical with or similar to the designated goods and deliver, sell, forge, imitate, or possess such trademark for the purpose of using it or making another person use it, and produce, deliver, sell, or possess tools for the purpose of forging or imitateing the registered trademark of another person or making another person forge or imitate the registered trademark.

피고인은 금은세공기술자 8명을 고용하여 타인의 등록상표를 도용하여 부착한 귀금속(이하 ‘위조 귀금속’이라 함)을 제조하기로 마음먹고, 2015. 1. 2.경부터 2015. 7. 16.경까지 서울 종로구 E빌딩 4층, ‘F’라는 상호의 귀금속 제조공장에서, 별지 범죄일람표 1-1 내지 1-8 기재와 같이 샤넬이 대한민국 특허청에 등록한 샤넬 상표(제0304800호)와 동일하거나 유사한 상표가 부착된 가짜 샤넬 금목걸이 등의 위조 귀금속 2,101점(정품추정가액 7,583,330,000원 상당)을 제조하여 종로귀금속 단지 내의 성명불상의 판매업자들에게 판매하였다.

In addition, as shown in the separate list of crimes (2) as shown in the separate sheet of crimes, the Defendant made a forged precious metal 254 points (amounting to 541,160,000 won), such as a fake powder and a similar trademark registered with the Korean Intellectual Property Office (No. 0417806), and stored them for sale, and kept them for the purpose of sale, and kept them for manufacture of a forged powder and a halfbris, etc., as described in the separate sheet of crimes (3), the Defendant kept 392 points (i.e., a single du), 392 points (i., a single duced value equivalent to 818,240,000 won) for manufacturing precious metal as indicated in the separate sheet of crimes (3).
