A defendant shall be punished by imprisonment for a term of one year and two months.

2,000,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant handled the Meteptop clopty (one philopopon; hereinafter “philopon”), which is a local mental medicine, as follows:

1. On May 3, 2018, the Defendant: (a) called “DE” and “F” to purchase a philopon in contact with a name-free box (DIDE” and “F”) who sells philopon in the vicinity of the Central Financial Center in Bupyeong-si B, B, not more than 22:59 on May 3, 2018; and (b) transferred 400,000 won of the purchase price to a bank account in the name of G (Account No. H) designated by the above non-titled person, using a cash automatic withdrawal machine located in the aforesaid C Bank prue, Dong-dong Comprehensive Financial Center; and (c) then purchased a philop on the first floor of a building where the above person was unable to know the address less than the green dong number in Eunpyeong-gu, Seoul, and purchased a 0.5 g of the philopon in total from that time to June 21, 2018.

2. On May 25, 2018, the Defendant, at around 21:50 on May 25, 2018, intended to contact the above names in D with the above names in the vicinity of the said C Bank prudented Integrated Financial Center, to purchase the philon, and then, transferred 400,000 won of the price to the C Bank account in the name of G bank account (Account Number: H) designated by the above person who was not the above name due to the use of the automatic cash withdrawal machine located in the said C Bank prudented Comprehensive Financial Center.

After that, the defendant tried to purchase a philophone by finding out the philophone which was hidden in advance, but the defendant did not find a philophone by leaving contact without informing the place where the philophone was hidden.

Accordingly, the defendant tried to trade philophones, but attempted to do so.

3. On May 4, 2018, the Defendant, who administered philophones, shall be accompanied by approximately 01:30 square meters.
