A defendant shall be punished by imprisonment for six months.

1,260,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant handled the Meteptop clopty (one philopopon; hereinafter “philopon”), which is a local mental medicine, as follows:

1. On May 16, 2018, the Defendant recommended to purchase and administer a philophone with B around May 16, 2018.

On May 16, 2018, around 22:29, the Defendant and B decided to contact C with the sales of the non-personal phone name “D” and purchase the penphone. The Defendant, along with B, transferred 4,30,000 won to the F bank account (Account Number: H) in the name of G designated by the said non-name-based person using the automatic cash withdrawal machine located in the F Bank-dong Integrated Financial Center in Gangdong-gu Seoul Metropolitan Government.

After that, the Defendant purchased philophones by finding approximately 0.5g of philophones which were concealed in advance by the winners of the above name in the outside machine of the commercial building in Gwanak-gu, Seoul Special Metropolitan City.

Accordingly, the Defendant conspired with B to sell philophones.

2. On June 21, 2018, the Defendant: (a) around June 21, 2018, attempted to sell or purchase phiphones; (b) around June 201, 2018, the Defendant agreed to contact F Bank H branch around the F Bank H branch in Yangcheon-gu Seoul, with C to purchase phiphones; and (c) transferred the price of KRW 430,000 won to the F Bank account (Account Number: H) in the name of G bank designated by the above F Bank H, using the automatic deposit and withdrawal machine located at the said F Bank H branch.

After that, the defendant tried to purchase a philophone by finding out the philophone which was hidden in advance, but the defendant did not find a philophone by leaving contact without informing the place where the philophone was hidden.

Accordingly, the defendant tried to trade philophones, but attempted to do so.

3. On July 3, 2018, the Defendant trading Handphones around July 3, 2018 at around 12:06 around July 3, 2018, near F Bank No. K in Gangdong-gu Seoul Metropolitan Government.
