A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

『2018 고단 258』 성명 불상자는 중국 등 해외에서 ‘ 콜센터’ 사무실을 차려놓고 불특정 다수의 피해자들을 상대로 전화하여 검사, 검찰 수사관 등을 사칭하고 마치 피해자들이 범죄에 연루된 것처럼 말하면서 금융기관에서 돈을 인출하여 놓으라고 거짓말을 하여 피해자들 로 하여금 은행에서 현금을 인출해 놓도록 하고, 피고인( 현금 수거 책) 은 위 챗 앱을 통하여 성명 불상자의 지시를 받아 미리 정한 장소에서 금융감독원 직원인 것처럼 행세하면서 현금을 준비해 온 피해자들을 만 나 돈을 건네받은 후 이를 성명 불상 자가 지시한 계 죄에 입금하는 방법으로 피해자들의 금원을 편취하는 전화금융 사기( 일명 ‘ 보이스 피 싱’) 범행을 하기로 공모하였다.
