Reasons
Punishment of the crime
Even if the Defendants were not the narcotics handler, they dealt with psychotropic drugs-related Mepters (tentatively called philophones, hereinafter referred to as “philophones”) as follows:
1. Defendant A
A. On July 2014, the Defendant offered approximately 0.1g of philopon to F at the Defendant’s house located in the Nam-gu Incheon E-Ba 302, Nam-gu, Incheon, and offered it to F without compensation.
B. (1) On September 2014, the Defendant: (a) sold philophonephones to a police officer on the first time on September 2014, 2014; (b) sold KRW 1.75g of philophones to F, who received one million of the purchase price and delivered 1.75g of philophones to a police officer in the vicinity of the Nam-gu Incheon National University, Nam-gu, Incheon.
(2) On October 5, 2014, around October 5, 2014, the Defendant: (a) around October 5, 2014, sold 00,000 won in the house of the above Defendant; and (b) delivered F with approximately 0.75g of phiphones.
(3) On October 11, 2014, the Defendant, around 12:00 on October 11, 2014, sold 1.4 grams to F, after receiving 1.1 million won of the purchase price, around the street near the boundary line in the Nam-gu Incheon Metropolitan City, Nam-gu.
(4) On October 11, 2014, the Defendant, around 13:00 on October 11, 2014, sold 0.35 grams to F, after receiving the purchase price of KRW 400,000,000 and delivering F, around 0.35 grams.
(5) On October 15, 2014, around October 15, 2014, the Defendant sold philophones by delivering approximately 6.46 grams of philophones to F, at the home of the above Defendant around 16:00 on October 15, 2014.
(6) On October 15, 2014, the Defendant sold philophones, around October 23, 2014, in a street room near the Bupyeong-gu Incheon Bupyeong-gu, Incheon, at around 23:00, sold 1.4g of philophones to F, after receiving 1.2 million won of the purchase price.
C. (1) On July 2014, the Defendant: (a) Handphone medication was inserted in a single-time injection machine with approximately 0.05g of phiphones from the Defendant’s home, while on July 2014, 2014.
