1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The following facts may be found in full view of Gap evidence Nos. 1, 2, 3, and 4, and evidence Nos. 5-1 and 5-2, and the purport of all arguments.

The defendant and D completed the registration of ownership transfer on the portion of 1/2 of C Forest land 7,259 square meters in Yangju-si, Gyeonggi-do prior to the division on March 3, 198.

B. D, before the division on December 30, 2009, completed the registration of ownership transfer in the name of A clan (representative E) on the ground of the termination of the title trust as of July 17, 2009, on the portion of 1/2 of C Forest land 7,259 square meters in Yangju-si, Yangju-si, Gyeonggi-do.

C. Before the division, C forest was divided into 3,630 square meters of C forest land and 3,629 square meters in Yangju-si, Gyeonggi-do (hereinafter “instant forest”) and F forest and 3,629 square meters in Yangju-si, Gyeonggi-do.

A A A The registration of ownership transfer for shares of 1/2 of the clans A among the forest land of this case on December 23, 2015 was completed in the future of the Defendant on the grounds of division of the common property owned by December 22, 2015, and the forest land of this case was owned solely by the Defendant.

E. Meanwhile, the Defendant completed the registration of ownership transfer in the future of A clan (representative E) on the ground of the division of common property owned by the Defendant on December 22, 2015 among the above F Forest divided on December 23, 2015, and the said F Forest divided under the name of A clan alone was owned by the Defendant.

G. Article 2 of the Rules of the Plaintiff on September 28, 2015 consists of adults over 20 years of age among the rear descendants.

Article 7 shall be classified into an ordinary general meeting and an extraordinary general meeting.

(1) A general meeting shall be convened by the chairperson at the request of each year.

(2) The Chairperson shall convene an extraordinary general meeting where necessary, and the Chairperson shall convene a meeting when a majority of executives request.

(3) The convocation of a meeting shall be notified by stating the purpose thereof one week.

H. On January 20, 2016, the minutes of the minutes of the extraordinary general meeting, at least a majority of all members of the Plaintiff, were requested to possess real estate, and the convocation procedure is omitted. In order to change the name of the instant forest land to the Plaintiff, the Defendant filed a lawsuit against the Plaintiff regarding the instant forest land.
