1. The defendant shall be punished by a fine not exceeding 1.5 million won;

2. If the defendant does not pay the above fine, 10,000 won.

Punishment of the crime

Defendant 2016 Highest 2707 is a full-time user who operates steel-rein concrete construction business with ten full-time workers in Gangseo-gu Seoul Metropolitan Government and the second floor (ju) D representative director.

When a worker dies or retires, an employer shall pay the wages, compensations, retirement allowances, and other money and valuables within 14 days after the cause for such payment occurred, unless there exists an agreement between the parties on the extension of the due date for payment.

Nevertheless, the Defendant did not pay the total of KRW 4,569,530 for three workers within 14 days from the date of retirement without an agreement between the parties on the extension of payment deadline, as well as KRW 1,69,740, retired from the said workplace to November 30, 2015, as well as KRW 1,696,740, which was included in the list of crimes 1.

Defendant 4154 is the representative director of Gangseo-gu Seoul Metropolitan Government (ju) D in Gangseo-gu, Seoul. Defendant 2 is the employer who subcontracted “H” located in Gangwon-si, Gangwon-si, Gangwon-do, from around September 2014 to December 2015, and was employed by 30 full-time workers from around December 2014 to around December 2015.

When a worker dies or retires, the employer shall pay the wages, etc. within 14 days from the date on which the cause for such payment occurred, unless the parties have agreed to extend the payment date.

Nevertheless, the Defendant did not pay 9,100,000 won in total, including three workers’ wages, within 14 days from the date of retirement without any agreement between the parties on the extension of payment period, as stated in the list of crimes in attached Table 2, including the amount of wages of 3,80,000 won in December 2015, when the Defendant retired from office as working at the above construction site from October 20, 2015 to December 31, 2015.
