A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant: (a) accessed the victims who were identified to be able to engage in gambling together with C, D, E, F, and Micks; (b) induced them to gambling; (c) used the fabricated card name “Ombane” and the inner name “Ombane” with the prior indication on the card; (d) concealed the fact that he embling with each other by informing the accomplices who participated in gambling of the fact in secret; and (c) conspired the Defendant and other accomplices to receive 40% of the money by fraud from the victims, and 60% of the money by fraud by the Defendant and other accomplices, as if they were genuine gambling.

가. 2006. 12. 6.자 범행 피고인은 D, 성명 불상의 여자 2명(일명 : H엄마, I엄마)과 함께 2006. 12. 초순경 속초시 J에 있는 K식당에서 미리 위 식당에서 피해자 G와 함께 식사를 하던 C을 우연히 만난 것처럼 가장하여 합석한 후 피해자를 도박판으로 유인하고, C, D, 성명 불상의 여자 2명은 함께 2006. 12. 6. 21:00경부터 다음날 03:00경까지 강원 고성군 L에 있는 M콘도 호실 불상의 객실에서 피해자와 카드 7장씩을 나눠 가진 다음 정해진 족보에 따라 승자를 정하는 이른바 ‘세븐포카’를 하면서 속칭 ‘탄’과 ‘표시목’을 이용하여 승부를 조작하였음에도 불구하고 마치 진정한 도박을 하는 듯 행세하고, 피고인은 그 사실을 잘 알면서도 진정한 도박을 하는 것처럼 행동하며 옆에서 술, 안주를 제공하는 등 심부름을 하여, 이에 속은 피해자로부터 55만 원을 딴 후 즉석에서 성명 불상의 남자가 피해자에게 빌려준 5,000만원을 다시 땄다.

Accordingly, the defendant, in collusion with C, by deceiving the victim, obtained a total of 50,550,000 won from the victim and acquired it by fraud.

B. The crimes committed on December 7, 2006 by C, D, and two females with no name (one person: Hmorma, Imorma) together with the crime committed on December 7, 2006.
