1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff, including the part resulting from the supplementary participation.

1. Details of the disposition;

A. The Plaintiff is a school foundation that establishes and operates C University. The Intervenor joining the Defendant (hereinafter “ Intervenor”) was newly appointed as an associate professor at C University’s management university around August 1994, and was promoted to full-time professors around April 1997. From February 1997 to November 2002, the Plaintiff was appointed as the principal of the management university and the principal of the management graduate school.

B. On March 13, 2013, the president of the Cuniversity requested a disciplinary committee of C University Teachers’ Disciplinary Committee (hereinafter “Disciplinary Committee”). After holding a meeting of the Disciplinary Committee, the Disciplinary Committee decided to punish the Intervenor on April 18, 2013 on the ground that the Intervenor’s act constitutes grounds for disciplinary action under Article 61(1)3 of the Private School Act, i.e., when the Intervenor’s act constitutes “when he/she undermines his/her dignity as a teacher regardless of his/her duties” (hereinafter “instant grounds for disciplinary action”).

Accordingly, on April 24, 2013, the president of the Cuniversity dismissed the Intervenor (hereinafter “instant disciplinary action”).

1. An act of impairing the honor of the Cuniversity by distorted and spreading information about the D Foundation (hereinafter “Disciplinary Reason 1 of this case”);

A. (1) On December 4, 201, 201, under the title “(1) of the C University homepage,” “The background leading up to investigating financial misconduct at a management graduate school and publishing an investigation report,” and the title “(1) of the title “EN” representing the position of the F Director, referring to what is different from the fact, and as such, the title “EN’s writing representing the position of the F Director,” refers to the FF graduate school site, and the background leading up to investigating financial misconduct that occurred at the management graduate school and announcing an investigation report, shall be informed to the members until the report on investigation is published,” and under the title “a summary of the research report,” the title “FFF source development fund has been appointed from August 204 by the graduate.”
