피고인과 C은 2017. 11. 16. 05:00 경 서울 송파구 D 소재 ‘E’ 음식점에서 피해자 F(25 세) 이 나이를 속였다는 이유로 시비되어 피고인은 피해자를 발로 차고, 피해자의 머리를 붙잡아 무릎으로 2회 올려 찍고, 주먹으로 얼굴을 수회 때리고, C은 이에 가세하여 주먹으로 피해자의 머리를 때리고, 넘어진 피해자의 얼굴을 왼발로 2회 찼다.
