Defendant

A is a person who operates food manufacturing and processing business under the trade name of "B farming association" in Gangnam-si D, and Defendant B is a corporation with the purpose of manufacturing and selling food, etc.

1. Defendant A

(a) Foods, the standards and specifications of which are determined by the Minister of Food and Drug Safety to determine the standards and specifications for manufacturing, processing, using, cooking, and preserving foods for national health (hereinafter referred to as "food code"), shall be manufactured, imported, processed, used, cooked, and preserved in accordance with such standards, and foods, the standards and specifications of which are not complied with, shall not be sold or manufactured, imported, processed, used, cooked, stored, subdivided, transported, preserved, or displayed for sale, for the purpose of sale.

⑴ 피고인은 2013. 2. 27.경 위 B영농조합법인 사무실에서, 식품 원료의 안전성 및 건전성이 입증되지 않아 위 식품공전에서 식품원료로 사용할 수 없도록 규정된 ‘개똥쑥’의 꽃과 줄기를 물과 함께 가열 추출하여 100㎖ 파우치에 포장한 다음, 이를 경남 함안군 E에 거주하는 F에게 G[프리미엄] 60포를 판매하여 위 식품공전에서 정한 기준과 규격에 맞지 아니한 식품을 판매한 것을 비롯하여 위 일시경부터 2013. 4. 21.경까지 별지 범죄일람표 1 기재와 같이 총 77회에 걸쳐 ‘G’ 총 134박스(100㎖x30포, 총 4,020포) 합계 7,250,000원 상당, ‘G[프리미엄]’ 총 48박스(100㎖×30포, 총 1,440포) 합계 5,174,000원 상당을 판매하는 등 위 식품공전에서 정한 기준과 규격에 맞지 아니한 식품 12,424,000원 상당을 판매하였다.
