The defendant shall be innocent.

1. The summary of the facts charged in the instant case is as follows: (a) from around September 1, 2010 to around 17, the Defendant, using a radio network provided by telecommunications business operators, such as SK Telecom, KT mobile communications, LGU, etc., engaged in the business of providing contact Denz in a way that the Defendant would make the users of the wireless Internet contact using the wireless network, which was provided by telecommunications business operators, pay the service fees from the cell phone users, including the mobile phone usage fees.

On March 14, 2011, the Defendant sent a text message stating that “I have one copy of a photograph stored in the service,” as if I sent the text message to the cell phone users, such as the victim I’s cell phone (J) without notifying that the information service charge is imposed, by accessing a mobile phone text message, etc., which is a large-scale mobile phone delivery site, at H’s office located in Yongsan-gu, Goyang-gu, Mangsan-si.”

However, the fact was that the mobile phone users did not send the text message, and the fact that the text message confirmation is charged with the net information usage fee.

The Defendant had the victim I, etc. confirm the above text message, and had the victim I, etc. receive economic benefits by imposing KRW 2,990 for information usage fees, and from September 1, 2010 to April 21, 201, the Defendant sent text message to an unspecified number of mobile phone users in the name of 17 companies, such as F, etc., in the name of an unspecified number of mobile phone users, and had the victims settle the total sum of KRW 501,307,110 for 192,851, and acquired economic benefits equivalent to that amount.

2. With respect to the facts charged of this case, the fact that the Defendant deceivings the victims, ① the text message sent to the victims who are mobile phone users was sent as if they were sent by the branch, and the victims were exposed to this, and paid contents via the radio network connected by the text message.
