1. The Defendant’s KRW 150,45,405 as well as 5% per annum from January 23, 2015 to October 20, 2016 to the Plaintiff.

Facts of recognition

The plaintiff is a company that manufactures and supplies surface treatment automation facilities to the Vietnam plant of Samsung Electronic Co., Ltd. (hereinafter referred to as the "Sesung Electronic Co., Ltd.")

The Defendant is a company that manufactures and supplies a tank containing the amount of paints among the surface processing automation facilities (hereinafter referred to as “instant tank”).

On November 18, 2014, the Plaintiff and the Defendant concluded a contract for the supply of the instant tank products with the total price of KRW 1,150,000,000 (excluding value-added tax; hereinafter the same shall apply), down payment of KRW 460,000, intermediate payment of KRW 345,000,000 (payment upon arrival of the second-minute Samsung Nam Factory), the remainder of KRW 345,00,000 (payment upon arrival of the third-minute Samsung Nam Factory), and the place of delivery of the instant tank 108.

However, the Plaintiff requested the Defendant to suspend and resume production on more than two occasions through the C Deputy Director affiliated with the Manufacturing Support Team, and did not pay the down payment until December 3, 2014.

The Defendant suspended work from December 2, 2014 on the ground that the Plaintiff’s unilateral notification of the discontinuance of production and the payment of the down payment, and demanded the Plaintiff to reorganize the payment period, etc.

Accordingly, on December 4, 2014, the Plaintiff and the Defendant concluded a production contract for the instant tank 108 (hereinafter “instant contract”) with respect to the instant tank 108 (hereinafter “instant contract”), and drafted the following contract:

The plaintiff, Eul: The name of the defendant 1 [the terms of the contract and the payment period]: the amount of the contract under the STS316L 4T, 100,000,000 won (excluding value-added tax)

1. Delivery place: The place where the plaintiff was designated as the plaintiff's company or self-employed company;

2. Payment period: Article 3 (Payment of Price) on December 25, 2014

1. Contract deposit: 440,000,000 won (cash) - Issuance of contract performance insurance policy; and

2. Part payments: 330,000,000 won (cash) - Within seven days after suffering from the place of delivery of firsthand goods;

3. Balance: 30,000,000 won (cash).
