A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a person who has worked as a motor vehicle sales business employee at the point of Mano Samsung Samsung Motor Vehicle D at the time of the Gyeonggi-do Government.

1. On July 23, 2014, the Defendant: (a) sold MF3 vehicles to E visiting customers from the said car sales store; (b) sold the said vehicle to E; and (c) allowed the said E to purchase the vehicle using the loan method through the loan screening of the Victim F Co., Ltd. (Representative G). The Defendant considered the vehicle sales performance.

Accordingly, the Defendant made a false statement that the delivery price of the above SM3 vehicle was KRW 19,589,259, and the above vehicle was sold to the above E in KRW 21,29,400, and applied for a loan of KRW 20,300,000.

However, since the actual ex-factory price of the above vehicle was 17,296,364 won, if the damaged company knew of such fact, it was impossible to lend KRW 20,300,000.

Nevertheless, the defendant deceiving the damaged company as above and immediately received 20,300,000 won from the National Bank Account (Account Number: 45290720070753) in the name of Hano Samsung Samsung-&M Co., Ltd. from the victimized company.

2. On July 28, 2014, the Defendant altered official documents, at the place indicated in paragraph (1) on July 28, 2014, printed out documents stating “19,589,259 won” using a computer located in the above office from the said FF Co., Ltd., and subsequently altered the shipment price of the motor vehicle registration certificate, which is a certificate for the rights and obligations issued by the KM3 motor vehicle registration certificate, by posting them on “17,296,364 won” column and by creating copies on “17,296,364 won.”

3. The Defendant holding an altered official document will continue to exist at the time and place specified in paragraph 2 and make the copy of the altered registration certificate to the said FF FF FF corporation, who is not aware of such circumstances.
