Reasons
Punishment of the crime
"2019 Highest 9289"
1. At around 02:40 on September 25, 2019, the Defendant stolen the property owned by the victims of the total market value of eight times from around that time, including: (a) the Defendant opened a driver’s seat of the victim C’s DNA learning vehicle; and (b) theft with one point at a level equivalent to KRW 20,000 in the market price owned by the victim; and (c) the Defendant stolen with one point at a level equivalent to KRW 20,000 in the market price of the victim’s possession; and (d) from around November 7, 2019, the Defendant stolen the property owned by the victims of the total market value of KRW 94,370 in total, eight times, as shown in Appendix 1.
2. The Defendant attempted to larceny, from October 20, 2019 to around 19:00 of the following day, opened a door of the Glearning car owned by the victim F and attempted to steals property at the apartment parking lot in Michuhol-gu Incheon, Michuhol-gu, Incheon, between around 07:40 on October 20, 2019, but did not commit an attempted crime without any goods to be stolen.
3. On November 3, 2019, the Defendant violated the Computer, etc. Fraud and the Specialized Credit Financial Business Act: (a) around 04:28, 201, purchased visibility equivalent to KRW 99,00 at the market price from the key machine in front of the Incheon Yandong-gu Hospital located near the Incheon Yandong-gu Incheon Metropolitan City, and exempted the Defendant from paying the settlement amount by settling the sum of KRW 205,200 from the key machine up to 11 times in total, as shown in attached Table 2 of the Crimes List 1, 6, such as the settlement by using the agricultural credit card in the first name that stolen as shown in paragraph (1).
Accordingly, the defendant acquired economic benefits equivalent to the above amount and used stolen cards by inputting information into computers and other information processing devices without authority.
4. On November 7, 2019, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) around 03:41 on November 7, 2019, by presenting the KB national card in the name of the victim, which was stolen as one of his/her card, as set forth in paragraph (1) No. 1 No. 8; and (b) paying 25,000 won, and using the stolen card.
