A defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
1. At around 01:00 on October 13, 2012, the Defendant: (a) opened a e-mail vehicle owned by the victim D, which was parked in the Dong-gu Gwangju metropolitan street; and (b) opened a e-mail vehicle owned by the victim D and driven the e-mail vehicle with the key located in the cargo vehicle, thereby cutting down the said cargo vehicle in an amount equivalent to KRW 2,50,000, the market price of the victim D owned by the Defendant; and (c) stolen the said cargo vehicle in an amount of KRW 2,420,000,000, total market price of KRW 2,420,000.
From that time until August 12, 2013, the Defendant stolen another’s property worth KRW 22,495,000 in total, from that time until August 12, 2013, as shown in attached Table 1.
2. Around 04:00 on May 16, 2013, the Defendant: (a) removed the window shielding network of the above main points that was operated by the Victim G G in the Republic of South and North Korea, and intruded inside the main points, and stolen the said network with a 12 knife amounting to KRW 432,00,000 in the market price owned by the victim, and 1 knife tobacco equivalent to KRW 25,00 in the market price in the knife.
3. Fraud and violation of the Specialized Credit Finance Business Act;
A. On June 13, 2013, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) purchased tobacco 1 A in the K convenience store operated by the victim I located in the JJ of Jeonnam-do on June 13, 2013; (b) purchased a tobacco 1 A, and (c) made a settlement with the victim I as if he/she had a real right to use a stolen card (credit card number : M) as described in No. 1 No. 5 of the List of Crimes No. 1, 500; and (c) received a tobacco 1 A, the value of which is the 2,500 won per the market value from the victim I.
B. The Defendant, at around 03:57 on June 13, 2013, purchased drinking water and booming, etc. from the O convenience points operated by the Victim N located in J of Donam-gun, and completed the new card (credit card number : M) in the name of L, which was stolen to the Victim N, as described in No. 1 No. 5 of the annexed crime inundation No. 5.
