Reasons
Punishment of the crime
1. On October 5, 2013, the Defendants’ co-principal-offendered Defendants posted a notice stating that they sell the victim E’s net gold 10 egs, reflects, etc. at the NAD website on October 5, 2013, and promised to purchase gold egs at KRW 2 million by contact the victim by Defendant A with the victim to purchase gold egs at KRW 2 million.
At around 02:00 on the same day, the Defendants met the victim at the Yeongdeungpo-dong 1, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu, 618, but Defendant B provided the victim with a check number of KRW 100,000 (F-G) and KRW 400,000 in cash prepared in advance.
However, the check issued by the Defendants was found in the IPC toilet located in Geumcheon-gu Seoul Metropolitan Government at the end of May 2013, and around May 15, 2013, the Seoul Southern District Court entered the public summons procedure and rendered a judgment of nullification on or around September 2, 2013, and the Defendants were well aware of the fact. Therefore, the Defendants did not have any intent or ability to pay the price for the gold.
The Defendants, as seen above, got the victim into deception and were issued 10 gold 2,00,000 won at the market price of 2,00,000 from the victim’s seat.
2. Defendant A
A. At the end of May, 2013, the Defendant embezzled a lost driver’s license that was lost by the victimJ at the influent park event in Geumcheon-gu Seoul Metropolitan Government, but did not take necessary procedures, such as returning it to the victim, and embezzled the lost property from possession.
B. The Defendant for unlawful uttering of official document is a person 2 who is requested to present identification cards by E while trading with E at the time and place specified in paragraph 1.
The Seoul Local Police Agency, a public document acquired as described in the paragraph, presented a driver's license to J in the name of the Seoul Local Police Agency, and exercised it unlawfully.
