1. Presumed factual basis

A. The Plaintiff was established on April 17, 2015 and engaged in software development and supply business, etc., and the Administrator of the Small and Medium Business Administration (the current Small and Medium Business Administration became a small and medium venture business entity due to organizational restructuring) supported a business plan in the “B business” publicly announced the implementation plan of the date C, and was selected as a support task in the knowledge service field on December 15, 2015.

With respect to the instant task, on December 24, 2015, the Plaintiff entered into an agreement with the Defendant Technology Information Promotion Agency for Small and Medium Enterprises and agreed to receive KRW 90 million from the Government contributions.

The main contents of the Convention relating to the instant case are as follows:

(1) In carrying out the development project, the implementing authority must comply with the Act on the Promotion of Technology Innovation of Small and Medium Enterprises, Enforcement Decree of the Act, operational guidelines for the development of technology of small and medium enterprises, management guidelines for the development of technology of small and medium enterprises, and management regulations for the technology development support projects of small and medium enterprises.

(2) If the relevant laws and regulations are amended or new laws and regulations governing this Convention are enacted, the amendment of the Convention in Article 9 by notification in writing or by electronic document of a specialized institution shall be set out in Article 6.

The phrase “Article 6” appears to be a clerical error.

In lieu of the procedures for amendment to the term agreement, the amended provisions shall be recognized as the content of this Convention without the separate procedures for amendment.
