A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who has been engaged in the business of manufacturing and selling comprehensive kitchen devices in the name of E from 123 to 127 in Bupyeong-gu Incheon Metropolitan City.

In 2012, the Small and Medium Business Administration promoted the future leading task implementation plan among the small and medium technology innovation development projects for small and medium enterprises in order to support the future promising development of technologies, such as green technology, high-tech convergence, and manufacturing foundation, and the selected enterprises provided government subsidies.

On July 6, 2012, the Defendant submitted to the Small and Medium Business Administration a business plan to provide the Government contributions of KRW 400 million as a plan to perform the task of “development of food processing equipment using heat from electronic inducement heat” in the total project cost of KRW 546 million from June 1, 2012 to May 31, 2014. Around that time, the Defendant was selected as an executing company of the project to support the development of small and medium enterprises, following the deliberation and coordination by the Korea Evaluation Institute of Industrial Technology, which is a specialized institution, and entered into an agreement with the aforementioned technology development project manager and the aforementioned task.

On July 17, 2012, the Defendant applied to the Small and Medium Business Administration for a government contribution of KRW 200 million for the first year as if he/she would develop the food processing equipment using the heat of electronic inducement, and received a subsidy of KRW 200 million from the Small and Medium Business Administration to the E-company bank account in the name of E-company.

In using KRW 200 million of the State subsidy for the first year as a small and medium enterprise technology development support project operator for the above task, the defendant may not use the subsidy for the first year after the approval of the Korea Institute of Industrial Technology Evaluation and Planning if it is used only for the purchase cost of research equipment, reagents which are material cost, trial work cost, etc., or for any other purpose, such as the contents of the small and medium enterprise technology development agreement with the Small and Medium Business Administration on July 6, 2012.
