Reasons
Punishment of the crime
Defendant
A is a person who is the planning director of the D Hospital, and the defendant B is a person who has served as the representative of the occupants of the Busan E apartment, and the defendant C is the head of the management office of the above E apartment.
A person is unable to obtain signatures or seals from electors for an election campaign and is prohibited from making an election campaign except as otherwise provided for in the Public Official Election Act prior to the election campaign period. However, in the 21st election campaign, he declared on March 11, 2020 that G (the founder of a D Hospital) who was the preliminary candidate for the election district belongs to the above constituency, Defendant A requested the apartment resident to have the signature of Defendant B or the above “G-free-affiliated signature” signed at the Da Hospital neighboring the D Hospital located in Busan, around March 12, 2020, and Defendant B consented to the request of the apartment resident to get Defendant C or the above “G-free-affiliated signature” signed at the above E apartment management office around March 13, 2020.
Accordingly, Defendant C, around March 13, 2020, displayed “written signature of the support from the Gu resident” to “I” on the above E apartment 1st floor, and, on the other hand, was signed by 45 electors, such as the residents of the above apartment, such as the residents of the above apartment, by stating that “I would like to leave the G candidate from the e-line to the F constituency to which he belongs,” and that “I would request the support signature from the e-line to the F constituency to which he belongs.”
