A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant was in possession of a copy of his identification card No. B, etc., and was able to borrow a loan in the name of B or use a mobile phone using it.
1. On February 11, 2014, the Defendant forged private document: (a) within the D office where the Defendant working in Busan District of Busan District; (b) in the form of a loan transaction contract for a social loan company A&P lending contract, the Defendant written “three million won” in the column of the loan with a black pen, “B” in the customer name column, and “E” in the resident registration number column; and (c) signed the name next to B.
Accordingly, for the purpose of uttering, the Defendant forged B’s loan contract and mobile phone entry application form in the name of “B” and “B” in the name of each of the following five times as shown in the list of crimes: (a) the Defendant forged a private document on rights and obligations; and
2. The Defendant at the time and place specified in paragraph (1) of this Article: (a) delivered a forged loan transaction agreement and an application for entering into a mobile phone with a total of five times as indicated in the attached Table of Crimes (1) to a lending company and a mobile phone agent, respectively, to an employee in the name of E&P loan company, who was aware of the forgery, by facsimile, as if the contract was duly formed.
3. The Defendant, at the time, at the time, at the place specified in paragraph (1), filed an application for a loan to an employee with the name of the victim E&P loan company, and had the Defendant induced the said employee by presenting the forged B B’s loan contract, and a copy of his/her identification card as described in paragraph (1).
The defendant, as such, has received three million won as a loan from an employee under the name of a social loan company E&P to whom the defendant was accused, for the same day.
