A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around December 20, 2012, the Defendant made a false statement to the effect that “The Defendant would have planned livestock pens and would have contributed to the Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’s Do’.”

However, even if the defendant borrowed money from the victim, he did not think that the victim would contract the construction work of a stable, and he did not have any intention or ability to repay the borrowed money to F personal debt.

Ultimately, the Defendant, by deceiving the victim as above, received KRW 46,50,000 from the victim as the borrowed money, to the agricultural bank account under the name of the Geumcheon-do Environment-Friendly Farming Cooperative around December 27, 2012.

2. On January 30, 2013, the Defendant made a false statement to the effect that, “If the president of G in Busan (the Defendant’s mother’s mother) who called the victim D at an unsound place, did not leave the Republic of Korea in Japan and borrowed the money, he would pay the chairman’s tax and return the money according to his return.”

However, the Defendant did not have any relative relationship with the above G and did not have any intent or ability to repay the loan even if he borrowed money from the victim.

Ultimately, the Defendant, by deceiving the victim as above, received 3.1 million won from the victim to the Agricultural Cooperative Account under the name of the Defendant on the same day.

3. Around March 19, 2013, the Defendant made a false statement to the effect that “G Chairperson made an investment therein, whether compensation was paid from the Water Resources Corporation, and he/she will make a full payment within a week if he/she lent appraisal fees.”

However, the Defendant did not have any relative relationship with the above G, and G did not have invested in the said farm, and also borrowed money from the victim.
