Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On August 20, 2017, at around 00:20, the Defendant: (a) while driving a 76-ro 76-ro, Daegubuk-gu, Daegu-gu, Daegu-ro, and driving a 76-ro 76-ro dong-ro, and received a vehicle contact report; and (b) voluntarily accompanied the Defendant to a traffic accident investigation leader of the 130-ro, Daegu-gu Police Station, Daegu-gu, Gangwon-gu, Seoul-do, and called for after receiving a vehicle contact report; and (c) from around 00:50 on August 20, 2017 to 01:10 on the same day, the Defendant was driven under the influence of alcohol by the Defendant, such as taking a smell from the said D, demanding the other driver to take a alcohol test by the Defendant at the scene of the accident.

There is a considerable reason to suspect so that it was demanded to respond to the measurement of drinking by inserting the whole in a drinking measuring instrument three times.

Nevertheless, the defendant did not comply with a police officer's request for a drinking test without justifiable grounds.
