1. Defendant A shall be punished by imprisonment with prison labor for one year;

However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

A is the regular business of the J Cooperatives (hereinafter referred to as the “J”), Defendant B is the head of the special business of the J, Defendant C is the head of the J's school meal service project, Defendant C is the head of the J's school meal service project, K is the deputy head of the J's school meal service project, L is the deputy head of the J's Gangnam Business, M is the head of the Gangnam Branch of the J, and N is the head of the Gangnam Branch of the J.

The bid price under the "School Meal Electronic Procurement System" operated and managed by the Public Procurement Service (the head of a country) and the Korea Agricultural and Fishery Products Distribution Corporation (EAT) shall be determined by the method of "the lowest bid price system", where 15 preliminary prices are determined within the scope of 【3% of the basic amount disclosed by the public announcement entity, the average of the four preliminary prices selected by the bidders among the four preliminary prices selected by the bidders are determined among the two preliminary prices. The successful bidder shall be determined by the method of "the lowest bid price system", in which the successful bidder is selected as a successful bidder at a minimum higher price than the lowest bid price than the lowest bid price.

The Defendants, together with K, L, M, and N, demanded the J customer centers under their management to participate in a large number of bids as much as possible in the process of supplying milk through a bid through the “School Meal Electronic Procurement System”, and distributed the estimated price according to the public tender notice so that the bid price does not overlap, and each customer center pre-designated the bid price by telephone, etc., and then, the actual supply is intended at the nearby customer center in the school even if any customer center receives a successful bid.

On February 2, 2017, the Defendants: (a) assigned 38 J customer centers, such as the J customer Center, to participate in the said electronic bidding in accordance with the electronic bidding notice of “O”, and (b) assigned 38 J customer centers, such as the J Docheon Customer Center, with a different amount of bidding; and (c) ordered each customer center to participate in the bidding on a different amount of bidding; and (d) received a successful bid by the J Docheon Customer Center in the said electronic bidding.
