1. Defendant A shall be punished by a fine of KRW 7,000,000.

The above defendant did not pay the above fine.

Punishment of the crime

E The regular business of F (hereinafter referred to as the “F”), G is the F’s special business director, H is the F’s head of the F’s special business group, H is the head of the F’s meal service business group, Defendant A is the deputy head of the F’s school meal service group, Defendant F’s deputy head of the Gangnam-gu business group, Defendant F is the head of F’s Gangnam branch, and J is the head of F’s south branch.

The bid price under the "School Meal Electronic Procurement System" operated and managed by the Public Procurement Service (the head of a country) and the Korea Agricultural and Fishery Products Distribution Corporation (EAT) shall be determined by the method of "the lowest bid price system", where 15 preliminary prices are determined within the scope of 【3% of the basic amount disclosed by the public announcement entity, the average of the four preliminary prices selected by the bidders among the four preliminary prices selected by the bidders are determined among the two preliminary prices. The successful bidder shall be determined by the method of "the lowest bid price system", in which the successful bidder is selected as a successful bidder at a minimum higher price than the lowest bid price than the lowest bid price.

The Defendants, together with E, G, H, I, and J, demanded F customer centers under their management to participate in a large number of bids, as much as possible in the process of supplying milk through a bid through the “School Meal Electronic Procurement System”, and each customer center pre-designated an amount of bid to be invested by each customer center by telephone, etc. to ensure that the estimated price according to the public tender notice does not overlap, and then, the actual supply is intended at the nearby customer center in the school even if any customer center receives a successful bid.

On February 2, 2017, the Defendants: (a) assigned 38 F customer centers, such as FF new customer centers, to participate in the said electronic bidding in accordance with the electronic bidding notice of KAA and ordered and managed by an elementary school through the head of the country of the Public Procurement Service; and (b) assigned 38 F customer centers, such as FF new customer centers, with each other of the different bidding amounts, and (c) had each customer center participate in the bidding; and (d) the FF new customer centers received a successful bid in the said electronic bidding, but actually supplied the goods.
