Punishment of the crime
[Criminal Power] On April 19, 2018, the Defendant was sentenced to one year of imprisonment with prison labor for habitual fraud, etc. at the Seoul Southern District Court (Seoul Southern District Court) on May 11, 2019, and completed the execution of the sentence in the first prison of the Northbukbuk Branch.
【Criminal Facts】
1. On October 21, 2020, the Defendant: (a) around 11:00, the Leecheon-si, Leecheon-ro, 1200, the Defendant obtained pecuniary benefits equivalent to the amount of the taxi fee by failing to pay KRW 94,00,00, for the Defendant’s failure to pay KRW 94,00,00, for the Defendant’s failure to pay the taxi fee to the Central District of the Jeju-si Police Station located in 11:30 on the same day, while doing so as if the Defendant had no intent or ability to pay the fee but would normally pay the fee.
2. On October 24, 2020, the Defendant was provided with property equivalent to KRW 210,000,000, in relation to “F” entertainment tavern operated by the victim E in the Republic of Korea on October 24, 2020, when the Defendant was committed as if he did not have the intent or ability to pay the price, and was provided with property equivalent to KRW 210,00,000, such as beer 1 sheet and beer.
3. On October 25, 2020, the Defendant: (a) around 00:28, the HA located in G in the Haju-si; (b) was active as if the Defendant had no intent or ability to pay the fare, and was engaged in the work as if he would normally pay the fare; and (c) moved to J-si operated by the victim I to the original taxi located in the 158 LA as of 00:34 on the same day; and (d) failed to pay KRW 4,680 on the 158-day LA and did not pay the 4,680 won of the taxi fee.
4. On October 25, 2020, the Defendant: (a) in the vicinity of the site and distance near the site located in the original city level around 03:06 on October 25, 2020; (b) in fact, as if he did not have the intent or ability to pay a charge, he did not normally pay a charge; and (c) in the absence of such intent or ability to pay the charge, he did not pay a 5,880 won of the taxi rate to the original city level located in the original city level around 03:18 on the same day; and (d) did not pay a 5,880 won of the taxi rate.
