Punishment of the crime
[2016 High 506] On September 13, 2015, around 17:14, 2015, the Defendant acquired the same amount of pecuniary benefits by failing to pay a total of 189,200 won for taxi charges and expressway tolls in the manner of returning to the above boarding place on the same day after going through the Yancheon-si located in Gangwon-do, Gangwon-do, where the victim B did not have an intent or ability to pay the taxi fare despite having taken aboard a taxi operated by the victim B, and having no intention or ability to pay the taxi fare.
[2016 High 509] On September 15, 2015, the Defendant took property benefits by failing to pay KRW 178,500,00 for the taxi to arrive at the said destination via the Seoul Special Metropolitan City, if he/she would take aboard the Dong in Gwangjin-gu, Gwangjin-gu, Seoul, and would pay for the taxi expenses to the D E company driven by the victim C, as he/she would be able to pay for the taxi expenses.

1. On September 17, 2015, around 20:00, the Defendant: (a) was driving as if he would pay the taxi fare despite having no intent or ability to pay the taxi fare; and (b) obtained financial benefits equivalent to the same amount as the Defendant did not pay a total of KRW 167,760 for the taxi fare and the expressway fare by returning to the above boarding place around 23:50 on the same day via the Southern Gyeongcheon-si Station located in Gangwon-do, Gangwon-do; and (c) did not pay a total of KRW 167,760 for the taxi fare and the expressway fare.
2. On September 18, 2015, the Defendant did not pay a total of KRW 171,040 on the taxi charges and the expressway charges in the manner of returning to the above boarding place on the following day through the South Chuncheon IC in Gangwon-do around 00:25 on September 18, 2015, on the roads of H station located in Gangdong-gu Seoul Metropolitan Government G, by boarding a taxi operated by the victim I, and driving as if he would pay the taxi charges despite the absence of the intent or ability to pay the taxi charges.
