1. The Defendants are jointly and severally liable to Plaintiff A to pay KRW 20,000,000 to the Plaintiff Co., Ltd. from December 8, 2016 to the date of full payment.
Reasons
1. Facts of recognition;
A. The Plaintiff Co., Ltd. (hereinafter “Plaintiff A”) is a company with the objective of design and supervision service business of architecture, etc., and the Plaintiff Co., Ltd. (hereinafter “Plaintiff B”) is a company with the objective of design and supervision service business of architecture.
The Defendant C Housing Redevelopment Promotion Committee (hereinafter referred to as the “Defendant Promotion Committee”) is an association establishment promotion committee to implement a housing redevelopment project under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents in Ysan-gu E-gu, Seoul, and Defendant D is the promotion chairperson of the Defendant Promotion Committee.
B. On July 17, 2014, the Plaintiffs entered into a design service contract between the Plaintiffs and the Defendant Promotion Division (hereinafter “instant design service contract”) with the Defendant Promotion Division. The key contents of the instant design service contract are as follows.
Design service contracts for multi-family housing (A) (Evidence 3)
1. Project name: C Housing redevelopment and rearrangement project;
2. Location of a building site: Toynsan-gu E in Jeonju-si.
3. Design: 1) Building area for a site: For the purpose of 53,684.0 square meters: Multi-family housing and ancillary and welfare facilities 3): Building area for a reinforced concrete structure 4): Total floor area for a 7,604.56 square meters (applicable at the time of the implementation of a plan): 138,92 square meters (it may be changed at the time of the progress of the plan): 138,992 square meters (it may be changed).
4. Contract area: 138,92 square meters (it shall be changed at the time of carrying out the plan).
5. Contract amount: The scope of services to be provided to “A” by the Chairperson of the Promotion Committee for the Establishment of Housing Redevelopment Improvement Project, the representative director of the A in charge of the settlement of accounts, “B” representative director G, and “B” under Article 3 (Scope, etc. of Contracts) of H, shall be the scope of services to be provided to “A” by means of preparing basic design drawings, working design drawings, and other design drawings necessary for the construction of buildings, and the scope of services provided to “A” to “B.”
