A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2016 Highest 1344]
1. Forgery of private documents;
A. On August 25, 2015, the Defendant: (a) prepared a “new service contract” by using an influence tool within the “C” mobile phone store located in the Namyang-si, B, 106; (b) stated the name, date of birth, address, settlement account, etc. of the victim D (age 22); and (c) written the victim’s name and seal in the signature and seal column.
Accordingly, the defendant forged a mobile phone subscription application in the name of D, which is a private document related to rights and obligations for the purpose of uttering.
B. On August 26, 2015, the Defendant forged one copy of the victim E (the age of 19) mobile phone entrance application by the aforementioned method at the above place.
2. Uttering a falsified investigation document;
A. On August 25, 2015, the Defendant exercised a forged document, as set forth in the foregoing paragraph 1(a) by submitting it to a “SK” telecom opening room.
B. On August 26, 2015, the Defendant exercised a forged document, such as the foregoing paragraph 1(b), by submitting it to a “SK” telecom opening room.
[2016 Highest 1775] The Defendant was a person who worked at the G mobile phone sales store in the F in Macheon-si.
1. On April 25, 2015, the Defendant forged an application form in the name of H, which is a private document on rights and obligations, for the purpose of exercising H’s signature on the customer’s name, stating in the customer information column the customer name “H”, date of birth, contact number, address, and applicant “H” and forged an application form in the name of H, which is a private document on the rights and obligations, with the aim of exercising his/her signature on the back of the name.
2. The Defendant, at the same time and place as in the preceding paragraph, sent the forged application form to the KT TT Telecommunication Agency, which may have knowledge of the fact, by facsimile, and exercised it.
[2016 Highest 2658] The defendant is an employee from the mobile phone sales store of the JJ located in Nam-si, Namyang-si.
