Defendant

A was denied by the 20th National Assembly member election that was implemented on April 13, 2016 to S in Seoul P election district, and Defendant B was the head of the election affairs of the T candidate, and Defendant C, D, E, F, and G were the members of the election affairs of each T candidate.

1. No person who committed the crime on April 11, 2016 of the election day of Defendant B, C, D, and E shall distribute, affix, spread, screen, or display any advertisement, letter of personnel management, poster, photograph, document, drawing, printed matter, sound or visual tape, and others similar thereto, including the contents supporting, recommending, or opposing a political party or candidate, from 180 days before the election day to the election day, without following the provisions of the Public Official Election Act.

Nevertheless, around April 10, 2016, the Defendants determined that the election district residents who supported Q candidates would be able to support T candidates by notifying the election district residents of the unfavorable contents to Q candidates that have been shipped to U in the P election district from the above election at issue on April 10, 2016, and solicited Q candidates to produce printed materials that contain the contents of opposing Q candidates and to spread them to the election district area.

At around 23:00 on April 10, 2016, the Defendants visited the “R” site by means of a computer, and distributed printed items containing the suspicion of construction cost for the WT remodeling project to the National Assembly Center and the Central Party Committee (from July 2006 to June 6, 2010) at the time of the employment of the Y head of the Gu.
