1. The plaintiff's claim is dismissed.
2. The costs of the lawsuit, including the part resulting from the supplementary participation, are all assessed against the Plaintiff.
Reasons
1. Details of the decision;
A. An intervenor is a school foundation that establishes and operates a D University and E University.
On March 1, 2014, the Plaintiff is appointed as a professor exclusively in charge of the E University F culture and education (the appointment period: from March 1, 2014 to February 29, 2016), and is reappointed on March 1, 2016 (the appointment period: from March 1, 2016 to February 28, 2018).
B. On September 28, 2017, the Intervenor sent a notice stating that the Plaintiff shall be reappointed on March 1, 2018, and that the requirements for reappointment include “an average of at least 75 points of education business evaluation, an average of at least 75 points of lectures,” “qualified person for the Board of Review of School Teachers”, “an evaluation of the four semesters prior to the expiration of the contract, excluding the first semester prior to the expiration of the contract, and the first re-contract evaluation of the three semesters prior to the expiration of the contract.”
C. On November 30, 2017, the E University Teachers’ Deliberation Committee deliberated on whether to re-appoint the Plaintiff, and the president of the E University notified the Plaintiff of the occurrence of the following grounds for refusal of re-election on the same day, and provided guidance to the Plaintiff to the effect that he/she will attend the Teachers’ Personnel Committee and present an explanation or present an opinion in writing, if any:
Article 7(2)1 of the Regulations on the Appointment of Professors in Exclusive Charge of Education (Related Provisions/Standards) 1 to 15-2 of the Regulations on the Review Results of Classification, at least 70 points of average points of 16-1 semester - average points of at least 75 points of average points of 81.0 points of 16-1 semester, but at least 75 points of average average points of 65.0 points of 65 points, and at least 75 points of average of average points of 75 points of 3 of the Regulations on the Appointment of Professors in Exclusive Charge of Education (Agreement on Appointment), Article 7(2)4 of the Regulations on the Appointment of Professors in Exclusive Charge of Education (Agreement on Appointment) of the Regulations on the Appointment of Professors in General, at least 60 points of average points of average points of 74.5 points of average points of the class of lectures: An eligible person of the Review Committee for the appointment of professors in Exclusive Charge of Education: lack of the standards for the evaluation field of education.
(d) The E University Teachers Personnel Committee shall be reappointed to the Plaintiff on December 15, 2017.
