Reasons
Punishment of the crime
[Criminal Power] On May 27, 2014, the Defendant was sentenced to two years of imprisonment for a violation of the Act on the Control of Narcotics, Etc., and was sentenced to one year of imprisonment for the same crime at the Seoul Eastern District Court on September 17, 2015 and the said judgment became final and conclusive on March 10, 2016, and completed the execution of the final sentence at the Daejeon Prison on September 14, 2017. On July 27, 2019, the Defendant was sentenced to five months of imprisonment for the same crime at the same court and completed the execution of the final sentence at the Daejeon Prison on September 14, 2017, and was not a person handling narcotics who is currently pending in the appellate trial after being sentenced to eight months of imprisonment for a violation of the Act on the Control of Narcotics, etc., at the Suwon District Court on July 27, 2019.
【Criminal Facts】
1. At around September 16:00 on September 7, 2018, the Defendant: (a) sold a philophone with approximately KRW 0.7 glopon, a psychotropic drug, which is a psychotropic drug located in a single-use injection machine, with the payment of KRW 300,000 from V, and with the payment of KRW 0.7 glopon.

3. Medication of phiphones.
A. At around 01:00 on March 7, 2019, the Defendant, at the residence of the Defendant in Namyang-si, put approximately 0.1g of philopon in a single-use injection machine, dilution in water, and injected philopon into the arms, and administered philopon.
B. On March 7, 2019, at the Defendant’s residence located in Namyang-si around the morning, the Defendant injected approximately 0.1g of philopon in a single-use injection machine, dilution in water, and injected philopon into the arms.
4. On March 7, 2019, the Defendant holding a penphones, at the AA parking lot located in the Suwon-si, Suwon-si around 14:55, kept approximately 0.17 g of the penphones on the bank possessed by the Defendant.
