A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 24, 2015, at the time of the dispute with the victim C(43) and the victim, the Defendant was aware of his/her physical disability with the victim, and had an undecent appraisal with the victim.

1. On December 29, 2015, the Defendant attempted to commit fire to the present owner’s building: (a) sought a door from the victim C’s residence located in Chungcheongnam-gun, Chungcheongnam-do to obtain apology on the above contents of the statement at around 22:30 on December 29, 2015; (b) sought a door to the victim C for the reason that the above victim did not open the door; (c) purchased gasoline 10 liters at the nearby gas station; and (d) sought gasoline again at the above place, and possessed gasoline purchased at the above place after putting it on the gate and floor.

With a single-use pen, the gate, etc. was destroyed by setting a fire to the gasoline fluor, a water meter lid, etc. on the floor, but the gate was fired by victim E (74 years), victim F (64 years old), victim G (n, 35 years old), and victim H (n, 46 years old), a family member of the victim C located in the above residence before the victim was moved to a residential building.

Accordingly, the defendant tried to extinguish the existing structure of the victims, but did not bring about such intent and did not commit an attempted crime.

2. The Defendant, at the time and place specified in paragraph 1, destroyed a fire with the same background as that specified in paragraph 1, followed by the victim F, etc., and knife the victim F, etc. from outside to find out the fire and to extinguish fire, knife the knife (27cm in total length, 15cm in length) knife and knife the victim C in the knife.
