A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. 특수공무집행방해 피고인은 2019. 5. 4. 08:50경 익산시 B에 있는 피고인의 주거지에서, ‘옆집 아저씨가 집안에서 뭘 때려 부순다’는 내용의 112신고를 받고 출동한 익산경찰서 C지구대 소속 경위 D과 경사 E이 위 주거지 대문 앞에서 피고인에게 물건을 마당에 던지지 말고 위 대문을 열어줄 것을 종용하였다는 이유로 화가 나, 위 경찰관들에게 “야이 경찰 씨발놈들아, 꺼져, 죽여버린다”라고 욕설을 하며 위 마당에 놓여있던 위험한 물건인 돌(지름 40cm)을 위 경찰관들이 서있는 곳을 향해 집어던져 위 대문 상단에 부딪치게 하고, 계속하여 위 마당에 놓여있던 위험한 물건인 화분을 위 대문과 천장 사이의 공간으로 집어던져 위 화분이 위 경찰관들의 머리 위로 지나가게 하여, 위 경찰관들의 생명과 신체에 위해를 가할 듯이 행동함으로써 위 경찰관들을 협박하였다.

Accordingly, the defendant carried dangerous articles and interfered with the legitimate execution of duties of the police officer on the handling of the 112 reported case.

2. At around 09:00 on May 4, 2019, the Defendant: (a) destroyed the said residence by putting the gasoline located in the boundary of the said residence into the front part of the house owned by the F, which was used as a residence, by the police officers having received 112 reports as above; and (b) putting the gasoline located in the front part of the said dwelling area into the front part of the house, which was used as a residence by the said female living together with the said female; and (c) setting the said dwelling area into the front part of the said dwelling area; and (d) setting the gasoline located in the front part of the said dwelling area into the lower part of the house owned by the F, which was destroyed by the fire under the market price.
