Punishment of the crime

Defendant

A was sentenced to six months of imprisonment for a violation of the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, Etc. at the Daejeon District Court on June 17, 2015, and the execution of the sentence was terminated on December 16, 2015. On August 23, 2018, the Daejeon District Court sentenced eight months of imprisonment for the establishment of gambling places at the Daejeon District Court on August 28, 2018, and the above judgment became final and conclusive on August 28, 2018. On September 1, 2017, Defendant B was sentenced to three years of imprisonment for the establishment of gambling places at the Daejeon District Court’s Incheon District Court’s Incheon District Court’s Incheon District Court’s 1 year and six months of the suspended sentence on September 9, 2017, Defendant C was sentenced to a suspended sentence of imprisonment for eight months from the Daejeon District Court to be embezzlement on May 1, 2017 and the above judgment became final and conclusive on May 9, 2017.

1. 피고인 A, 피고인 B의 공모범행 피고인들은 성불상F와 함께 일명 ‘도리짓고땡’ 도박을 할 수 있는 도박장을 만들기로 하고, 성불상F는 도박장 설치 및 관리를 담당하는 일명 ‘창고장’ 역할을, 피고인 A는 도박자들 모집 및 게임진행을 담당하는 일명 ‘총책’ 역할을, 피고인 B은 도박 참가자들 사이를 오가며 도금을 걷고 정산을 해주는 일명 ‘상치기’ 역할을 각각 담당하기로 순차 공모하였다.

피고인들은 성불상F와 함께 2017. 3. 일자불상 08:00경부터 10:00경까지 세종 전의면 산단길 인근 야산에서, 위와 같은 공모에 따라 성불상F는 일명 ‘창고장’ 역할을, 피고인 A는 일명 ‘총책’ 역할을, 피고인 B은 일명 ‘상치기’ 역할을 각각 담당하면서 그곳을 방문한 불상의 사람들이 일명 ‘도리짓고땡’ 도박을 할 수 있도록 하고, 7끗 이상의 족보로 승리하는 자로부터 그의 몫 중 일부를 수수료 명목으로 지급받았다.
