Defendant

A Imprisonment for one year, Defendant B, C, E, F, and G shall be sentenced to four months of imprisonment, Defendant D shall be sentenced to three months of imprisonment, and Defendant D shall be subject to three months of imprisonment.

Punishment of the crime

Defendant G was sentenced to eight months of imprisonment for the establishment of gambling places in the Gwangju District Court on August 13, 2013, and completed the execution of the sentence in the Gwangju Prison on February 23, 2014. Defendant F was sentenced to eight months of imprisonment for the establishment of gambling places in the same court on October 2, 2014 and completed the execution of the sentence in the Gwangju Prison on January 11, 2015.

Defendant A, “2015 Go-Ma1064,” played the role of “warehouse” in overall control of the installation and operation of a gambling place, and sexually unsound J, took the role of “pathm” referring to walking money in the gambling place, K and E referring to “pathm” referring to expenses, and conspired to open a gambling place by sharing the roles of “pathr” referring to the same as “pathm” referring to expenses.

1. 피고인 A은 위 K 등과 공모하여, 2013. 6. 20.경 새벽 전남 함평군 소재 불상의 야산에서 도박참여자 15~20명을 모아, 중앙 줄을 경계로 양쪽 바닥에 화투 20장을 이용하여 딜러가 화투 5장씩을 3패로 분배해 놓은 후 3패 중 한쪽은 총책이 먼저 선택하고 도박꾼들로 하여금 각자 나머지 두 패 중에서 어느 한 패를 선택하여 도금을 걸게 한 다음 화투 5장 중 3장을 이용해 10 또는 20을 만들고 나머지 2장을 가지고 끝수를 합하여 높은 쪽이 승하는 방법으로 속칭 ‘도리짓고땡’ 도박을 하게하고, 판돈의 5~10%를 속칭 ‘고리’로 떼어 이득을 취하였다.

2. 피고인 A은 K 등과 공모하여, 2013. 11.경 전남 영광군 소재 불상의 야산에서 도박참여자 15~20명을 모아, 제1항 기재와 같은 방법으로 속칭 ‘도리짓고땡’ 도박을 하게 하고, 판돈의 5~10%를 속칭 ‘고리’로 떼어 이득을 취하였다.
