1. The plaintiff
A. Defendant A and C shall indicate the attached drawings of 2,123 square meters of the land of Gwanak-gu Seoul Special Metropolitan City D forest 2,123 square meters.
Reasons
1. Facts of recognition;
A. The Plaintiff completed a share transfer registration with respect to 2,123 square meters of D forest in Gwanak-gu in Seoul Special Metropolitan City as follows.
For the purpose of registration of receipt, the Seoul Central District Court (Seoul Central District Court No. 47218, Oct. 2, 1980); 1653/50 of the co-owners' shares 5950, Oct. 2, 1980, the Seoul Central District Court (Seoul Central District Court No. 47219, Oct. 2, 1980) 337/5950 of the co-owners' shares 5950, Oct. 2, 1980
나. 서울 관악구 D 임야 2,123㎡ 중 별지 도면 표시 가, 라, 마, 바, 사, 아, 자, 차, 카, 타, 파, 하, 가¹, 나¹, 다¹, 라¹, 마¹, 바¹, 사¹, 아¹, 자¹, 차¹, 카¹, 타¹, 가를 순차적으로 연결한 선내 ㄱ부분 128㎡ 지상에 무허가 주택(이하 ‘무허가 주택’이라 한다)이 있고, 같은 도면 파¹, 하¹, 가², 나², 파¹을 순차적으로 연결한 선내 ㄴ부분 12㎡ 지상에 창고 건물(이하 ‘창고’라고만 한다)이 있다.
C. Defendant B is an owner of an unauthorized house.
Defendant B allowed Defendant A to reside in an unauthorized house, and Defendant A extended part of an unauthorized house.
Defendant A and C live in an unauthorized house as of the date of the closing of the instant argument.

2. Determination
A. According to the above facts, Defendant A and B without authority build and extend an unauthorized house and warehouse in part of the Plaintiff-owned D Forest in Gwanak-gu, Seoul Special Metropolitan City without authority and occupy the relevant part.
Defendant A and C, a resident of an unauthorized house, shall leave the unauthorized house without permission, and Defendant A and B have the duty to remove the unauthorized house and warehouse to the Plaintiff and deliver the relevant forest part, which is the site.
B. Defendant A’s assertion on Defendant A is the co-owner of Defendant B and unauthorized housing, and thus, the Plaintiff is not entitled to remove the housing.
