A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

【The Defendant was sentenced to six months of imprisonment for fraud at the Seoul Northern District Court on May 12, 2004, and was sentenced to a summary order of two million won in the same court on August 30, 2004.

[Criminal Facts]

1. The defendant habitually commits a traffic accident, following the driver's negligence, while walking along a vehicle coming slowly from the side road to the slowly, in contact with his/her own arms or legs intentionally, and then driving a traffic accident;

It is argued that the driver requested the driver to receive insurance, and the driver received the money from the victim insurance company that has purchased the insurance contract and the money in the name of the agreement.

On April 8, 2016, at around 20:45, the Defendant: (a) caused an accident by intentionally contacted the right side of the DNA-si car driven by C on the side side of the head of Songpa-gu Seoul Metropolitan Government on the side of the head of the car; (b) demanded the driver to receive the insurance; and (c) demanded the driver to receive the insurance; and (d) made a false statement to the employee in the name of the victimized company, a driver of the non-life insurance company, who was affiliated with the driver’s negligence, paid the insurance money to the employee in the name of the non-life insurance company; and (d) received 490,000 won from the victimized company as agreed money on April 11, 2016; and (e) received KRW 9,453,200 from around that time to May 26, 2016 as indicated in the attached list of crimes, and received KRW 15,000,000 from the victim, insurance company as the victim’s agreement.

In this regard, the defendant habitually obtained money.

B. On May 25, 2016, the Defendant attempted habitual fraud, at around 16:15, 2016, caused an accident by means of a method of intentionally contact the Defendant’s right hand hand hand hand on the upper right side of the FST5 car volume driven by E, i.e., the head of Songpa-gu Seoul Metropolitan Government Posing on the alley side of the head of a drinking house in Songpa-gu. However, the Defendant asserted that he was injured by the driver’s negligence, and received the insurance.
