Defendants shall be punished by a fine of KRW 2,000,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

Defendant

A is a public official who has been appointed as a public official on March 1, 1980 and has performed duties of managing and supervising civil engineering and landscaping works and related projects ordered by the Busan Metropolitan Government Office from March 7, 2012 as the head of F department of the Construction Headquarters of Busan Metropolitan City (Class IV technical officer) from March 7, 2012, and Defendant B is a representative director of the G Co., Ltd. established for the purpose of construction and engineering work.

1. On June 5, 2013, the Defendant: (a) performed the first phase first construction of the Busan Metropolitan City Construction Headquarters F department of the Busan Metropolitan City Construction Headquarters, located in the center of the Busan Metropolitan City Construction Headquarters 1001; (b) made a call to the representative director B of the G corporation awarded a successful bid in a general competitive bidding to the Busan Metropolitan Government J; and (c) received KRW 2 million in cash delivered through the above company’s employees M&A to request for a gift to retire from office at once; and (d) around June 11, 2013, the Defendant received KRW 2 million in cash delivered by the above company’s employees after requesting for a gift to retire from office at once; and (e) around June 11, 2013, the Defendant received KRW 2 million in cash delivered by the above company’s employees M&.

Accordingly, the defendant accepted a bribe of KRW 2 million in relation to his duties.

2. As described in the foregoing paragraph (1) above, the Defendant received demand from A to request KRW 2 million by telephone around June 5, 2013, and around June 11, 2013, Defendant B delivered KRW 2 million to A via the said Company’s employees M, with a view to changing various conveniences regarding the first work of the I development project and the K Landscaping work being carried out at the time of the Defendant’s operation as at the time of June 11, 2013.

Accordingly, the defendant given a bribe in relation to the public official's duties.
