Reasons
Punishment of the crime
1. On June 12, 2015, Defendant A, while operating a FMW car at the “E” racing track located in Gangwonwon D, caused the accident, and the vehicle was destroyed by the accident. Defendant A, despite being aware that the vehicle was damaged due to an accident in the course of driving a racing or racing, was not subject to automobile insurance, was able to claim insurance by pretending that the accident in ordinary operation occurred.
On June 12, 2015, the Defendant: (a) received a false accident from the victim G Call Center to the effect that “on June 12, 2015, the Defendant left to the left at a three-distance located at the right angle of Gangwon-do, Gangwon-do, Gangwon-do, Gangwon-do, at around 17:05 on June 12, 2015; and (b) caused damage to the vehicle to the right wing on the right wing day; and (c) filed a claim with the victim company for the payment of insurance proceeds on June 16, 2015; (d) around July 2, 2015, the Defendant got the victim company to transfer KRW 4,527,000 to the I bank account in its name; and (d) received from the victim company KRW 270,000,000 in terms of expenses for entrustment of disposal of total damages from the victim company.
Accordingly, the defendant, by deceiving the victim company, acquired the total amount of KRW 4,797,00 or acquired the pecuniary profit.
2. On September 18, 2015, Defendant B: (a) caused an accident while operating a motor vehicle of JNS Y at the “E” racing track located in Gangwonwon D; and (b) caused the damage of the motor vehicle; (c) in the event that the motor vehicle was damaged due to an accident in the course of practice for the racing or racing, Defendant B was aware of the fact that the motor vehicle insurance was not subject to compensation, and thus, had the intention to claim insurance money by pretending that the accident
On September 18, 2015, the Defendant was phoneed to the Call Center of the Victim G G Co., Ltd. on September 18, 2015, and was running along the road in the Doncheon-gun, Gangwon-do at around 10:15 on September 18, 2015.
