Reasons
Punishment of the crime
On April 17, 2012, the Defendant was sentenced to six months of imprisonment with prison labor for special larceny at the Busan District Court and such judgment became final and conclusive on August 10, 2012.
1. At around 01:50 on December 17, 2011, the Defendant thief caused the Defendant’s d (19 years of age, women) who met or come to know at “C” clubs in the same neighborhood of the Busan Jin-gu, Busan, to play games, and caused the Defendant’s confusion by using one for the game, and one for the defendant’s mack-si, the market price of which is equivalent to KRW 500,000,00,000,000, and four for the mack-si, the market price of which is equivalent to KRW 300,000,000,000, and one for the women’s mack-si, the market price of which is equivalent to KRW 60,00,00,000,000, and one for the 70,000,000,00 won.
2. Violation of the Specialized Credit Finance Act, and fraud;
A. At around 02:30 on December 17, 201, the Defendant purchased foodstuffs, etc. using a credit card at the convenience store in Busan-gu, Busan-do, as seen above, and acquired pecuniary profits equivalent to the same amount by deceiving the Victim F (20 years of age) who is an employee of convenience store as if he/she was his/her credit card, and settling 21,100 won as if he/she were his/her credit card.
B. On December 17, 2011, at around 02:42, the Defendant: (a) taken a taxi for H-business purpose operated by the victim G (age 47) in the French area in Busan City; (b) taken a taxi for the purpose of the operation of the H-business purpose; and (c) settled the taxi fare of KRW 2,640 by using a stolen DNA national credit card; and (d) obtained financial benefits equivalent to the same amount.
C. At around 03:30 on December 17, 201, the Defendant, upon receiving an massage treatment from 'I' of the Busan BY, he paid 210,000 won as if he were his card using a credit card to the victim J (28 years of age and inn) who is an employee, and acquired the same amount of pecuniary benefits.
