Reasons
Punishment of the crime
[Criminal Justice] On November 28, 2017, the Defendant was sentenced to two years of imprisonment with prison labor for an injury to the Jeju District Court for six months. On March 26, 2018, the Defendant was sentenced to four months of imprisonment with prison labor for a crime of fraud in the District Court Branch of Gwangju District Court on July 20, 2018, and the said judgment became final and conclusive on July 20, 2018, and the said suspended sentence was invalidated. On September 10, 2018, the Defendant was sentenced to four months of imprisonment with prison labor for a crime of fraud in the District Court Branch of Gwangju District Court, and completed the execution of the final prison on April 8, 2019.
【Criminal Facts】
1. On June 4, 2019, at around 16:20 on June 4, 2019, the Defendant: (a) opened a entrance and intruded into the second floor office of the church located in Gwangju Northern-gu, Gwangju, by using the cresh in which C is located; and (b) cut off the cash of KRW 60,000 and agricultural coke card owned by the victim from the wall located in front of the wall.
2. On June 4, 2019, the Defendant purchased a small amount of money equivalent to KRW 3,800 from the Mart, which is managed by the victim E in Gwangju Northern-gu, Gwangju, about 16:29, and paid KRW 3,800 to the above amount of money by settling the accounts with the above amount of 3,800 won, under the fictitious C’s lawful holder, as described in the above paragraph (1), from the time of using the stolen body card, from the time of using the stolen body card until 16:36 of the same day, the Defendant used the stolen body card more than six times, such as the list of crimes, and acquired 131,830 won in property profits.
3. On June 4, 2019, at around 17:52, the Defendant attempted to purchase one gold half of the amount equivalent to KRW 480,000 at the market price from a gold bank operated by the victim H in Gwangju Northern-gu, Gwangju, and to settle the amount of KRW 480,000 with the above physical credit card, in disguiseed to the legitimate holder of the Nong AF card, as described in the above paragraph (1), and to obtain pecuniary benefits equivalent to the said amount. However, the payment of the above physical credit card is made.
