Reasons
Punishment of the crime
Defendants are not authorized to handle narcotics.
1. The sole criminal conduct of Defendant A;
A. On August 31, 2019, the Defendant issued KRW 400,000 to E at the D Park located in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and purchased a penphone with approximately one gram of psychotropic drugs (one philopon; hereinafter “philopon”).
B. At around 20:00 on August 31, 2019, the Defendant’s house at the office of the Defendant of Bupyeong-gu, Incheon, Bupyeong-gu, U.S. G, 1-A.
In addition, approximately 0.3g of philophones purchased as described in paragraph (1), the philophones were administered by melting about 0.3g of philophones into beer.
C. At around September 22:30, 2019, the Defendant offered No. 1-A at the Hemoto room in Bupyeong-gu, Incheon, Bupyeong-gu.

2. Defendant B’s sole criminal conduct on September 1, 2019: (a) around September 22, 201, at the Hemoto’s guest room.

3. The Defendants’ co-offenders, together with purchasing philophones, decided to administer them. The instant indictment, which is a book selling philophones around 12:00 on September 3, 2019, is written as “L” but is corrected as it is a clerical error.
In contact with the I Messen, to purchase approximately KRW 700,000,00 in cash after withdrawing KRW 700,000,000 from the 15:45 on the same day, to purchase the above E in front of the K Messen in Seo-gu Incheon, Seo-gu, Incheon, and attempted to purchase the above E, and to attempted to arrest the police officer of the Seoul Guro Police Station.
As a result, the Defendants conspired to purchase philophones, but attempted to do so.
