A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

On September 6, 2012, the Defendant was sentenced to imprisonment with prison labor for the violation of the Military Service Act at the Seoul Western District Court on June, 2012, and the judgment became final and conclusive on October 17, 2013.

1. The Defendant: (a) around 02:00 on November 17, 2013, the second floor “D” in Seodaemun-gu Seoul, Seodaemun-gu, Seoul around 02:00, when drinking alcohol in combination with the victim E (the victim’s name, 18 years of age) and his/her conduct; and (b) took a port from the victim’s left hand as the victim and his/her conduct were used to use the victim’s right buckbucks that he/she was seated into the Defendant’s left hand; and (c) took part of the victim’s right buckbuck and his/her muck, by force, committed an indecent act by force against the victim.

2. 공무집행방해 피고인은 같은 일시장소에서 1항과 같은 사건 발생 신고를 받고 출동한 서대문경찰서 소속 경장 F, 순경 G에 의하여 현행범인 체포되어 112 순찰차에 탑승한 후 피고인의 일행을 태우지 않은 채 그대로 순찰차를 출발시켰다는 이유로 화를 내고, “왜 내 증인은 데려가지 않느냐 ”라고 소리를 지르며 발로 운전석을 수 회 걷어차고, 손으로 운전자 순경 G의 오른팔을 잡아 밀고 당기고, G가 순찰차를 정차시키고 경장 F가 피고인에게 수갑을 채우려고 하자 욕설을 하면서 발로 경장 F의 오른쪽 정강이를 차고, 손톱으로 경장 F의 양손을 할퀴고, 발로 순경 G의 오른쪽 허벅지와 왼쪽 정강이를 수 회 찼다.

As a result, the defendant interfered with legitimate execution of duties of police officers in criminal investigations.

3. The Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (the Act on the Aggravated Punishment, etc. of Specific Crimes, etc.) shall have been in favor of the victim G who drives the patrol vehicle as set forth in paragraph (1) at the same time and place as that set forth in paragraph (2) of this Article, and shall have been in favor of the victim by getting off his arms

Accordingly, the Defendant assaulted the driver of a vehicle in operation.
